1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and **modreck** (operated by Abdelrahman Tarek). If you disagree with any part of the terms, then you may not access the Service.

2. Merchant of Record

Our order process is conducted by our online reseller Dodo Payments. Dodo Payments is the Merchant of Record for all our orders. Dodo Payments provides all customer service inquiries and handles returns.

3. Description of Service

Modreck AI provides a platform that allows users to create, customize, and deploy AI-powered chatbots trained on their own data. We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice.

4. Accounts and Registration

To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

5. Content and Data

• Your Content: You retain all rights and ownership of the data, files, text, and other content ("User Content") that you upload to the Service. By uploading User Content, you grant Modreck AI a worldwide, non-exclusive license to use, reproduce, and display such content solely for the purpose of providing and improving the Service.
• Prohibited Content: You agree not to upload any content that is illegal, hateful, harmful, or violates the intellectual property rights of others. We reserve the right to remove any content that violates these Terms.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of modreck and its licensors. The Service is protected by copyright, trademark, and other laws.

7. Subscription and Payments

Certain parts of the Service are billed on a subscription basis ("Subscription(s)"). Payments are processed securely via Dodo Payments, our Merchant of Record. You will be billed in advance on a recurring and periodic basis (such as monthly or annually).

We reserve the right to change our pricing at any time. Any price changes will be communicated to you in advance and will take effect at the start of the next billing cycle.

8. Refunds and Cancellations

We offer a 14-day money-back guarantee for new subscriptions. For full details on our refund process and eligibility, please refer to ourRefund Policy.

Cancellation Process: You can cancel your subscription at any time from your account settings. Upon cancellation:

• Your subscription will remain active until the end of your current billing period
• You will retain access to all features until the period ends
• Your chatbots will stop functioning on external websites immediately after cancellation
• All your data (chatbots, knowledge sources, chat history) will be permanently deleted 30 days after cancellation
• No refunds will be provided for partial billing periods unless within the 14-day money-back guarantee window

9. Limitation of Liability

In no event shall Modreck AI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Egypt, without regard to its conflict of law provisions.
